Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Booth website, applications, and related services (the “Service”) operated by Booth (“Booth,” “we,” “us”). By creating an account or using the Service, you agree to these Terms.
1. The Service
Booth provides tools for creators to publish storefronts, sell digital and other products, collect payments via third-party processors, host courses, accept bookings, run email and marketing features, and related functionality. Features may change as we improve the Service.
2. Accounts
- You must provide accurate registration information and keep it updated.
- You are responsible for safeguarding your login credentials and for activity under your account.
- You must be at least 18 years old (or the age of majority where you live) to operate a creator account.
- We may suspend or terminate accounts that violate these Terms or applicable law.
3. Creator responsibilities
If you sell through Booth, you are the merchant of record for your offers unless we expressly state otherwise in writing. You are solely responsible for:
- Your products, content, pricing, delivery, and customer support
- Complying with consumer, advertising, tax, and export laws that apply to you
- Obtaining rights to all content you upload or sell
- Honoring refunds and chargebacks according to your stated policies and processor rules
- Not selling illegal, infringing, or prohibited goods or services
4. Payments
Payments are processed by third parties (e.g., Stripe, PayPal). Their terms apply in addition to ours. Processing fees are charged by those providers. Platform subscription fees for Booth (if any) are described on our Pricing page and billed separately.
5. Acceptable use
- No fraud, spam, malware, scraping that harms the Service, or unauthorized access
- No content that is illegal, hateful, exploitative of minors, or that infringes others’ rights
- No misuse of email/AutoDM features to send unsolicited messages in violation of law (including CAN-SPAM, GDPR, Meta policies)
6. Intellectual property
Booth owns the Service software, branding, and documentation. You retain ownership of your content. You grant us a limited license to host, display, and transmit your content as needed to operate the Service. Feedback you provide may be used freely to improve Booth.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, or any particular sales results.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOTH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO BOOTH FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
9. Indemnity
You will defend and indemnify Booth against claims arising from your content, products, storefront, customer disputes, or your violation of these Terms or law.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations, risk, or non-payment. Provisions that should survive (including IP, disclaimers, liability limits, and indemnity) will survive termination.
11. Governing law
These Terms are governed by the laws of the United States, excluding conflict-of-law rules. Courts of competent jurisdiction in the United States will have exclusive jurisdiction, unless applicable consumer law requires otherwise.
12. Changes
We may update these Terms. Material changes will be posted with an updated date. Continued use after changes become effective constitutes acceptance.
